Live Music Contractor Agreement

The expectations, responsibilities, and conditions for musicians contracted by My Music Match to perform at events.

Independent Contractor Status

The Contractor is engaged as an independent contractor and is not an employee, partner, or agent of My Music Match. Nothing in this Agreement shall be construed to create an employer-employee relationship.

Booking Details & Communication

All gig details will be confirmed by My Music Match via email, form, or other written communication prior to the event, and you must confirm receipt and acceptance of those details in writing.

Any changes to the gig, including adjustments to personnel, repertoire, technical needs, or set times, must be communicated to My Music Match as soon as possible. If changes are made, you are required to confirm in writing that you have received and accepted the updated details.

Payment

Payment will be made via direct deposit within the agreed timeframe after completion of the event and only for performances completed as agreed. It is the responsibility of the musician to ensure that all necessary payment information is submitted prior to the event.

Event payments are issued every Monday and Friday. Payouts are calculated based on the terms agreed upon in each event detail email and according to the pay periods listed below:

  • Events occurring Monday through Thursday are paid the following Friday.

  • Events occurring Friday through Sunday are paid the following Monday.

Professional Conduct & Representation

All instructions provided in your confirmed event details must be followed exactly as communicated. Musicians are expected to maintain a professional, respectful, and cooperative demeanor at all times, both on and off stage. This includes:

  • Treating clients, venue staff, vendors, and fellow performers with courtesy and respect.

  • Avoiding any behavior that could negatively impact the reputation of the performer, the event, or My Music Match.

  • Complying with applicable laws, venue policies, safety requirements, and reasonable instructions provided by My Music Match, the client, or event staff.

Unprofessional, disruptive, unsafe, discriminatory, harassing, intoxicated, or otherwise inappropriate conduct may result in immediate removal from an event, forfeiture or reduction of payment for unperformed services, removal from future bookings, termination of the Contractor's relationship with My Music Match, or other appropriate action as determined by My Music Match.

Appearance

You must dress according to the attire requirements provided in your event details. These requirements are mandatory and designed to ensure your appearance reflects the style and professionalism of the event. You are expected to maintain a clean, professional, and well-groomed appearance at all times.

Style & Repertoire

Each artist is booked through My Music Match based on their agreed-upon musical style, performance approach, and suitability for the specific event. The artist is expected to prepare and perform repertoire that aligns with these expectations and the event requirements provided by My Music Match. Any significant changes to style, repertoire, instrumentation, personnel, or performance approach must be communicated in advance and approved by My Music Match.

Arrival & Performance Timing

My Music Match events run on precise schedules, and punctuality is essential. Contractors are expected to arrive by the designated call time listed in their event details, fully prepared to perform. This includes being ready for sound check and starting performances promptly at the scheduled performance time.

Event schedules may include up to a fifteen (15) minute variation in start or end times, and Contractors are expected to accommodate this without additional compensation.

If a Contractor is late and, as a result, unable to perform, the Contractor will not be paid for that event. Late arrival without prior notice may also affect eligibility for future bookings. If an unforeseen delay occurs, the Contractor must notify both the onsite contact and My Music Match immediately.

Cancellations

If you must cancel your participation in an event, you must notify My Music Match immediately and, when possible, provide a qualified substitute.

If you cancel within fourteen (14) days of an event without providing a qualified replacement, your eligibility for future bookings may be affected. If My Music Match cancels an event within fourteen (14) days of the scheduled performance date, you may receive a cancellation fee as outlined in your booking confirmation.

No cancellation fees will be issued for cancellations resulting from force majeure events, including severe weather, unsafe conditions, venue closure, government restrictions, illness, emergencies, or other circumstances beyond the reasonable control of the parties.

Safety, Concerns & Reporting

Contractors who have concerns about unsafe conditions, inappropriate conduct, event operations, client interactions, or any other issue related to an event or their relationship with My Music Match should contact info@mymusicmatch.org as soon as possible. My Music Match will review concerns promptly and take appropriate action. Reports will be handled confidentially to the extent reasonably possible, and retaliation against a Contractor for raising a concern in good faith is strictly prohibited.

If a Contractor is uncomfortable reporting a concern through the general contact channel, or if the concern involves My Music Match leadership, the matter may be escalated to liana@mymusicmatch.org.

Confidentiality

All client, event, scheduling, and rate information provided by My Music Match is confidential and may not be shared outside of the organization without prior permission. Confidential information may be used only as necessary to perform services through My Music Match. You may share photos or videos from an event, provided the content is professional and appropriate and does not disclose confidential information.

Media & Promotion

Photos, videos, and other promotional materials from events booked through My Music Match may be used by My Music Match for marketing and promotional purposes.

Musicians are encouraged to share their own event-related content, provided it is professional and appropriate. When posting content related to a My Music Match event, tag @mymusicmatch where applicable. If you would like to create a collaborative post, contact My Music Match before submitting the request so it can be reviewed for compliance with our content guidelines.

Do not request a collaboration with any client, partner, venue, or event account unless they initiate it.

All shared content should be professional, appropriate, and suitable for all audiences.

Non-Solicitation

Nothing in this Agreement restricts the Contractor from marketing their services, accepting bookings, negotiating engagements, or performing work independently, provided such opportunities do not arise directly or indirectly through My Music Match.

The Contractor understands that they may be introduced to clients, venues, guests, vendors, planners, or other event-related contacts through events booked by My Music Match. Any performance opportunity, referral, booking inquiry, or other work opportunity arising directly or indirectly from a My Music Match event must be referred to My Music Match.

Examples include, but are not limited to:

  • An event guest expresses interest in hiring the Contractor for a future event.

  • A client requests additional services or future bookings.

  • A venue, planner, vendor, or other event-related contact expresses interest in working with the Contractor.

  • An individual or organization requests a referral, consultation, performance, or other paid service from the Contractor.

  • A prospective client contacts the Contractor after becoming aware of the Contractor through a My Music Match event.

In each of the above situations, the Contractor must refer the opportunity to My Music Match. The Contractor may accept and perform such services only if they are arranged through and compensated by My Music Match. The Contractor may not independently contract for, accept payment for, or perform services arising directly or indirectly from a My Music Match event outside of My Music Match.

Violation of this section may result in removal from future bookings, termination of the Contractor's relationship with My Music Match, and liability for damages incurred by My Music Match, including lost revenue and reasonable administrative or legal costs. These obligations survive termination of this Agreement.

Bandleader Responsibility

If this Agreement is signed by a bandleader or other designated representative on behalf of additional musicians, the signatory is responsible for ensuring that all participating musicians receive and understand the terms outlined in this Agreement.

The bandleader is also responsible for the conduct, punctuality, performance quality, and adherence to all My Music Match policies by every member of their group. Any violation of these terms by a band member will be considered a violation by the bandleader for the purposes of payment, disciplinary action, or removal from future bookings.

The bandleader represents that they have authority to accept these terms on behalf of all participating musicians in their group.
